There is a general concern for the human rights of all employees in the work place, due to the demographic changes in ethnic, religious, and racial tensions in the world this brings a challenge to the government and employers to find solutions in diversity and discrimination issues. Discrimination may be appeared to be prevalent, this may cause unemployment. Anti-discrimination policies have been employed to combat discrimination in the workplace, however nothing has been done to analyse the policy. This paper will examine whether the anti-discrimination legislation is effective in the workplace to provide a fair working environment.

Racism is defined as prejudice, discrimination, or antagonism directed against someone of a different race based on the belief that one's own race is superior. In a perfect world, people would be equal in rights, opportunities, and responsibilities, despite their race or gender. In the world we live in, however, we always face all kinds of neglect based on different attributes. All over the United States, certain people treat others with prejudice because of particular features they possess. Unfortunately, prejudice and discrimination occur even in places which, by definition, should be free of all personal prejudices – specifically, in offices and other business surroundings. This tragedy is called workplace discrimination; not every unfair behavior at work, however, can be assessed as discrimination. Discrimination in the workplace happens when an employee experiences unfair treatment due to their race, gender, age, religion, marital status, national origin, disability or veteran status, or other characteristics. Discrimination is one of the largest issues people face in the workplace and it must be dealt with. The U.S. have laws and regulations on discrimination but it still often occurs. Workplace discrimination appears in hiring, training, promotion, firing, and other institutional or interpersonal treatment. Discrimination sometimes causes an employee to leave or quit the workplace, resign from a position, or in more severe cases, to commit suicide or act violently against the discriminators. Discrimination is one of the largest issues many people face in the workplace.

Workplace diversity is defined as the similarities and differences among employees in terms of age, cultural background, physical abilities and disabilities, race, and religion. I am writing to you today to discuss the issue of minority discrimination in the workplace. Many minority groups in this country struggle to find stable jobs due to the fact that it is difficult to find sustainable employment. Despite popular belief, discrimination occurs every day worldwide. It occurs for different reasons, but is detrimental to any company or individual. The judgments that occur based on physical appearance, height, weight, gender, and race are affecting the potential professional careers of many. Many companies are limiting their full potential due to the fact that they are discriminating interviewees and employees based upon physical traits. It lessens the chances of developing a strong staff due to the stereotypes and generalizations that discrimination lends itself to. Great candidates are being turned away due to the false pretenses that discrimination brings. Although there are laws and organizations protecting the rights of workers, there has not been a stop put to discrimination.

Inside the legal profession of the United States of America, diversity is generally grasped yet rarely acknowledged. Women and minorities are horribly underrepresented. As indicated by the American Bar Association (ABA), just two callings (sciences and dentistry) have less variety than law including medication. Women constitute more than 33% of the profession yet just around 1/5th of firm partners, council of Fortune 500 enterprises, and graduate school deans.

Abrahams (1991) described the workplace as an ‘inhospitable place’ where gender disparity and wage gaps persist (Stamarski & Son Hing, 2015). Among other states and countries, the Australian government actively implements and passes laws to protect and maintain equal employment rights. While the objective of these laws is ‘to eliminate discrimination,’ the regulatory mechanisms in the legislation are largely ineffective at achieving this ultimate goal (Smith, 2008). However,

A current example of discrimination in the workplace deals with the fortune 500 company Microsoft. This case involved gender biases. A female former employee of Microsoft who was claiming that men were promoted more frequently than their female counterparts brought about this lawsuit. She believed that this was a result from unfair performance appraisal procedures. She claimed that men were given superior performance evaluations strictly based on gender and not on their actual performance (Rao, 2015). Upon researching this lawsuit further, it was discovered that this was unfortunately a trend in the technology field. Within 6 months of when this lawsuit was filed, there were similar cases involving Facebook, Twitter, and Silicon Valley occurred.

An essential part of the economy, job employment affects the lives of people of all races and socio-economic statuses. A large number of minorities are experiencing unemployment. It is becoming more and more prominent that racial discrimination is the source of the large employment differences between races. Vincent Rosicgino, a professor specializing in gender and race studies at Ohio University, referred to a study done in Boston and Chicago where employers were sent resumes with the same qualification some with a typical white sounding name and some with a typical black sounding name. Whites were called back 10.1 percent of the time and only 6.7 percent of the blacks were called back (Rosicgino). For many minorities, it is shocking to realize that a name, often with great cultural significance, is preventing their success in business.
