Analysis of Racial Profiling In the Criminal Justice System
Police officers today face many challenges. Some concerns include dangers or safety concerns related to being a police officer, questions of the use of force and the public’s perception of officers being corrupt. Additionally, with cases of deaths and accusations that have come to the forefront about police throughout the United Stated, questions about police racial profiling have also come to light. Today’s police are considered to be corrupt and prejudice against minorities. Their image has been tarnished and police are now seen as the enemy. Many compare today’s law enforcement officers to the police officers that were prejudice and brutalized blacks during the civil rights

During the civil rights era, blacks traveled together and were quick to warn each other to stay quiet during traffic stops. They didn’t know what the slightest movement or a twisted word could result in. It was an understanding in the black community that fighting for you rights even in a peaceful manner or questioning the tactics of a police officer during a traffic stop or as they performed their duties was a sure road to death, arrest and or brutal beatings. In 1964, "Freedom Summer" was organized as a voter registration project in Mississippi. It was part of an effort by a coalition of civil rights groups to register black voters in the South. A large, racially mixed group of college students traveled to Mississippi to participate in the project. On June 16, 1964, two of the white students, Michael Schwerner and Andrew Goodman, and a local African American, James Chaney, disappeared. Their badly beaten bodies were discovered buried in an earthen dam six weeks later. They had been arrested by local police and released to the Klu Klux Klan. (Ware, 2013, p.1090)
Although there was progress for blacks during the civil rights movement, it was slow. Many great leaders emerged during this time and some like Martin Luther King became a sacrifice for the cause of equality and freedom. The tone of non-violence promoted by so many
Police brutality and office involved shootings have sparked national debate and created a strain between police officers and citizens. Recently, there have been more home videos that display acts of aggression by police officers. These police officers often use excessive forces or a condescending tone towards people of color which is why there needs to be a better way to mend police and civilian relationship. People should be able to trust the police in their communities rather than fear them.
A major concern for many law enforcement agencies is the effect of not stopping individuals they feel are suspicious, because of racial profiling. They also argue that due to the increase of concerns in regards to racial profiling it might cause police officers from stopping crimes in progress (AZ Attorney General, 2001:2). The ethical issue that arises is that some officers fear retaliation for telling supervisors about others who profile based on race; others fear that data collected in stops could be misused to punish law enforcement personnel. The union and association representatives have raised their concerns regarding the discipline (AZ Attorney General, 2001:3). They state that any employee accused of racial profiling should be provided with progressive discipline beginning with training and counseling (AZ Attorney General, 2001:2)
There is no question that police brutality, when it occurs, is one of the most egregious violations of public trust that a public servant can commit. Police officers, those individuals taxed with protecting the public from danger, should never be in a situation where they pose a threat to the public. Furthermore, there is no question that police brutality occurs. Moreover, generally when there are allegations of police brutality, there has been some type of underlying violent incident. In addition, while issues of brutality may seem clear-cut to a disinterested observer, it is critical to keep in mind that law enforcement officers are not presented with textbook examples of the appropriate or inappropriate use of force, but real-life scenarios involving quick decisions. There are many arrest and non-arrest scenarios where officers need to use force to protect self or others; and the degree of force required may be greater than what a disinterested observer would assume. Another recurrent issue in debates about police brutality is that racial bias appears to be a motive behind police brutality. When one considers that minorities are disproportionately likely to be arrested and convicted of crimes, one would expect to find a disproportionate number of minorities among those alleging police brutality. The brutality of the police force has been a long worldwide problem, but especially between the years of 2012-2016. Black people are being unjustly beaten and shot in plain sight for doing nothing while being unarmed. Journal of African American Studies “Blacks are viewed as deserving of harsh treatment in the criminal justice system” (482). “Black males with more “Afrocentric” features may receive longer sentences than blacks with less Afrocentric features like lighter skin and straighter hair”(482). Nowadays it is important to know about the police force. It’s important to know our rights as citizens and be careful around cops. Not everybody is good, but not everybody is bad also. In The New York Amsterdam News 21 people were killed by Chicago police in 2008. Entire families were being attacked. They believe it’s because of their skin color and how they are different. The year of racism started off with the world seeing the police murder of Oscar Grant. “The media have pushed people away from hearing the issue of police brutality, and it has fallen off of the radar screen.”(2) “You can’t give in. They will try to make an example out of you, try to break your spirit!”(2) African Americans say do not trust the cops with anything. “They will ruin you.”(2)
What made the murders even more of a national outrage is the fact that the corrupt Ku Klux Klan police attempted to cover up the crimes, and that it involved white people. Although this was another horrible moment facing the morale of activists and organizations, the Freedom Summer helped establish many more schools and influenced the signing of the Civil Rights Act of 1964. This paper outlines the studies, incidents, facts and statistics that have found evidence of racial profiling which causes distrust in the law enforcements (police, government etc0. Studies of racial profiling shows that blacks, Hispanics, Middle Eastern and other racial minorities are more likely to be stopped than those who are white. They are more likely to be stopped and searches, traffic stops, license and registration checks. In addition they are more likely to be ticketed or arrested after being stopped and search. Some scholars and studies believes that minorities being that are frequently stopped and searched has nothing to do with them being racially profiled. According to Roh and Robinson,” studies raise the possibility that minorities may be more involved in criminality (Gaines, 2006), some drug crimes (Lichtenberg, 2006), and speeding offenses (Lange, Johnson, & Voas, 2005), thereby justifying higher stop and arrest rates by police of some groups.” (Roh, S., & Robinson, M.)
Racial profiling is a very prevalent issue within the criminal justice system that is quite controversial, but there is a significant number of evidence that shows that racial profiling has been present since the 1600’s and continues to be a significant issue. Racial profiling is evident in the criminal justice system in various ways such as in interrogations, jury selection, misleading statistics, stops, and immigration laws. Racial profiling within interrogations and jury selection can be seen with the Brandley v. Keeshan case. Racial profiling within statistics can be seen in instances where the numbers focus on arrests and incarcerations that do not necessarily mean a crime was committed. Stops are seen as evidence showing racial profiling with a personal experience, and lastly, immigration laws are seen as showing racial profiling by the encounter of a Mexican American women had with an officer in Arizona.
Chapter 4 in The Color of Justice: Race, ethnicity, and crime in America, was about the relations between society and law enforcement officers. This has been a major topic, especially in the United States for a long time. The unfortunate statistic that minorities are more likely to encounter being killed, arrested, and victimized by excessive physical force; has been a real issue even in today’s society. However, police departments are trying to combat the way police officers interact with the community; especially those of color. Although steps have been takes there are still some instances where police aggression happens. Racial disparity in the Criminal Justice system has been a issue of discussion in our law enforcement for years. Statistics say the likelihood of imprisonment in a lifetime is 1 in 3 black men, 1 in 6 Latino men and 1 in 17 white men. (Bonczar2003) The search and seizure 4th amendment was passed in 1789 which was supposed to protect all persons of unreasonable searches, etc. In 1944 Gunner Myrdal wrote “it’s part of a policeman’s philosophy that Negro criminals or suspects that show any sign of insubordination should be punished bodily, to keep the negro in his place.” In the late 1960’s early 70’s there were many riot commissions that recommended changes in police practices, especially aggressive stop-and-risk procedures.(Skolnick1969) Racial disparities have been an issue for years, especially in traffic stops. There are a couple different approaches to help reduce or end racial profiling. The ACLU’s 5 part battle plan to end racial profiling (Harris2003), and The Racial Justice Improvement project (ABA2010). Racial profiling is an issue in many aspects of the Criminal Justice system. This paper will mainly be based on traffic stops and in sentencing.
Racial profiling in law enforcement is referenced when a law enforcement officer targets an individual for suspicion of a crime. A broader definition of racial profiling in law enforcements is when a law enforcement officer, uses an individual’s race or ethnicity, age , time of the day (usually later in the day), dress code and also location to accuse a person of a crime. In today’s world the term racial profiling can be viewed in various view points, because of people having different opinions on the term, many disagreements occur. Some people believe that specific incidents are not cases of racial profiling and others think otherwise, needless to say an argument occurs.
Throughout the last one hundred and fifty years, there has been a history of tension and conflict between the police and minority communities in the United States. In principle, the police exist to enforce the law and protect all citizens regardless of race or ethnic background, yet police departments across the country have been repeatedly accused of targeting and harassing racial minorities, and of failing to root out racist attitudes and practices within their ranks. In recent years, high profile cases such as the beating of Rodney King in Los Angles and the assault on Abner Louima in New York have only served to heighten concerns over the mistreatment of minorities by the police, resulting in widespread calls for major legal and institutional reforms. The recent shootings of Michael Brown, Ezell Ford, Eric Garner, and Terrance Crutcher underscore the danger Black men and boys face when they cross paths with law enforcement officers. In the absence of a coordinated national strategy, state and local police departments have largely been left to develop their own solutions to the problems of policing minority communities and improving cultural sensitivity amongst their officers. Many departments have sought to reform recruitment and selection policies in the hope of attracting greater numbers of minority applicants, while others have instituted diversity training and education programs aimed at improving police understanding of minority cultures and communities. To date, however, these efforts have yielded mixed results. Some departments have achieved notable successes, but on the whole, relations between the police and minority communities across the country remain strained. of cultural diversity and the police.
There is recent controversy over police use of force, especially in minority communities such as in African American communities, Hispanic communities, and other publics with large populations of minorities. Increased levels of force among these communities have created challenges for police departments. These challenges include a lack of trust from the community towards law enforcement officers and an absence of respect creating situations that lead to police use of force. There are already various programs in place that attempt to decrease this challenge by educating the public, respecting one another, and giving those who were on the wrong track second chances. A combination of these solutions and the implementation of more of them would decrease the number of contacts between police and minorities that lead to the use of force (Roberg & Novak, 2014).
A great deal of society views law enforcement officers as heroic and honorable individuals, whose main purpose is to protect and serve the community. For many officers, this description is accurate, however for others; violence and brutality against innocent citizens is part of getting the job done. The civil rights movement caused tension and gained attention everywhere. There were many harmless protests that the African Americans were doing so they could achieve change. They had many leaders who fought for the rights, for example, Martin Luther King Jr and Rosa Parks. They wanted to see change and they spoke to their followers about how they can pursue change. With Martin Luther King Jr Campaign, the civil rights movement moved at a fast pace.
These days, police are often stereotyped as aggressive, corrupt beings. The growing hatred for police officers widens the divide between citizens and law enforcement, causing tension and intensely aggressive feelings on both ends. The recent shootings of young African-American men have also added to the societal hatred of law enforcement. Through media exposure, these shootings have been portrayed as cruel, often times revealing the victim to be an unarmed man.
