Adriana Ciacciarella Family Law Professor Dosio February 6, 2024 Short Essay Discovery Assignment
Short Essay Discovery Assignment To: Attorney Juliana Dahl Johnson Date: February 6, 2024 Re: Renee Alberston Divorce & Discovery Outline Case Overview A thorough discovery procedure would be necessary in the case of Walter and Renee Albertson. The discovery should investigate the financial complexities and assets owned by the pair as well as the potential ramifications of Walter's purported extramarital affair. The divorce case between Walter and Renee appears to be based on antagonism, mistrust, and suspicion even from the briefest overview, raising the possibility that the discovery process will be turbulent and illuminating. In the Albertson's case, there are numerous details to consider, one of those details being, Walter says he has forgiven Renee for her previous infidelity, but his behavior suggests he resents her actions. It is important to investigate the ways he has allowed this fight to affect the marriage because it seems to have more than one effect. This resentment potentially has an impact on how he has handled their finances and day-to-day operations. Mary E. Wilson, Family Law for the Paralegal 186 (3rd ed., 2017) (eBook). Renee claims Walter is having an affair, although most of the couple's troubles appear to arise from financial disparities and unproven accusations. Steps must be taken to determine the amount of assets that Walter has elsewhere in the world, and the house must be appraised to determine its exact worth. Since there are so many accusations in this case, there must be many steps taken to obtain the truth. For example, he may need to produce some kind of proof of the details surrounding his holiday in Aruba, of someone giving him a cash gift as a replacement for a car, which might be provided by the dealership from whom he purchased the car, as well as provide more detail on some of the very expensive purchases he has made on his credit card.
